Thane Session Court granted bail to several accused of Palghar lynching case.
Court cited that,
Bail is rule and Jail is an exception

Court observed that accused should not be detained as pretrial conviction.

Court opined that, keeping accused in Jail won’t be serving any purpose. It won’t help in investigation. Court finally considered the bail terms and granted them the bail.
No purpose of the prosecution would be solved by keeping the accused behind bars.
On 16th April, mob lynched three persons, in which two were 70 year old Sadhus.
Charges were put against the mob under Distraction of Public Property Act, Maharashtra Police Act, Disaster Management Act and Epidemic Disease Act.
Special Public Prosecutor alleged that the accused were part of the unlawful assembly.
However, the opposition, suggested otherwise. It was contended that, people just gathered there out of the curiosity.
Court clarified that, it is still unsure, if the accused were there lynching or just passerby.
Consequently, Court granted all of them bail.
